ABCD Welcomes Disability Rights New Jersey in December

Disability Rights New Jersey’s (DRNJ) Legal Director, Michael Brower and Director of Investigations/PADD Coordinator, Jill Hoegel joined the December meeting of ABCD’s Quality Assurance Forum to discuss Human Rights and Sexuality Policy. The discussion focused on an individual’s right to normal expression of intimacy and sexuality (not maladaptive behavior, or victimization).  Regrettably the HCBS laws and regulations have not changed enough to follow people living in the community.   Some takeaways for providers

  • First and foremost, the expressed wishes of the individual must be considered. These wishes cannot be overridden merely because someone has a disability. They may only be overridden through the courts or for clinical reasons.
  • Better education for agency and school staff, families, and support coordinators.
  • Person Centered Planning Tool (PCPT) and Individual Service Plan (ISP) need to be revised to guide those who may neglect to consider this aspect of life as something to be considered.
  • Day programs and support coordinators should have access to the full list of rights listed in an individual’s guardianship order.
